why in your hypo does he have to either kill her or drop his gun? He had more choices.

He can't keep his gun trained on her till the police arrive and take the shot if she does make a move for your hypothetical hidden gun?

the dude is 80, his reactions probably aren't great and he is likely in a lot of pain because of a broken collar bone. He kinda had to put her down right away.

the longer you let someone with a weapon/possible weapon stay alive the longer they could find the moment to kill you.

Me either. Especially since this was the third damn time she did it.

Old man will most likely be charged. I honestly don't see why he wouldn't be. I'm not licensed in Pennsylvania, but I'm pretty sure they don't have the Texas Chuck Norris rule.

ETA: I guess this was in Cali.

No he didn't and you are making up and assuming things to fit your point.

To argue your point though, his broken collarbone and being 80 is somewhat offset by the first bullet he put in her.
