Sexual Battery (misdemeanor) arrest means what exactly??

And if the person was 17 when it happened (turned 18 since it happened) they're tried as an adult or juvenile??

And if the kid turned 18 at least 3 months after it happened, it does make me wonder why the charges were later brought up at least almost 3 months later if not more.

How long is the road ahead of this kid?? And no, it's not my kid.

eta: I maybe should clarify my question: What's "sexual battery" as opposed to "sexual battery (misdemeanor)"??

17 is an adult in Louisiana. It takes between 30-120 days to screen a case sometimes, and can take longer depending on victim participation, police reports, etc.

And fwiw, it's a touching of the genitals without consent. It's punishable by 0-10 and isn't probatable, assuming the victim wasn't a child.

Well the one thing you can garuntee is that the kid won't get a job fee college.

Regardless of what happens, when someone looks up his back ground it will show that he was arrested for sexual battery and look like a sexual predator.

He is screwed

Thanks ... I was curious as to the holdup. No clue how old the accuser is; assuming (possibly incorrectly) that the person was "around" the same age.

So if it's a "misdemeanor" it does or does not follow you around forever??? I'll assume that it does.

There's no such thing as a misdemeanor sexual battery unless something changed recently. Sure it isn't a simple battery?

I believe if you stay out of trouble you can get it removed off your record at some point.

On his mug shot online it shows "14:43.1.1" but then says "Sexual Battery (misd)".

Louisiana Revised Statute 14:43.1.1

A. Misdemeanor sexual battery is the intentional touching of the breasts or buttocks of the victim by the offender using any instrumentality or any part of the body of the offender, directly or through clothing, or the intentional touching of the breasts or buttocks of the offender by the victim using any instrumentality or any part of the body of the victim, directly or through clothing, when the offender acts without the consent of the victim.

B. Whoever commits the crime of misdemeanor sexual battery shall be fined not more than one thousand dollars, or imprisoned for not more than six months, or both.

C. The offender shall not be eligible to have his conviction set aside and his prosecution dismissed in accordance with Code of Criminal Procedure Article 894.

D. The offender shall not be subject to any provisions of law that are applicable to sex offenders, including but not limited to any provision that requires the registration of the offender and notice to the public.

I'll assume he can plead not guilty and go to trial OR just plead guilty and take his lumps??

What kind of bond does this come with???

We know the parents and the kid ... not someone that I'd want my son to be hanging around with and definitely not someone I'd want my daughter to date even prior to this.

Arrested, bonded out and then went to school. Can you imagine??? Once dismissal happened, every student in school knew. Not sure how they found out as I'm sure it wasn't him telling everyone what happened. But maybe it was ... idk.
