Sewerage & Water Board worker fired for brass theft must be rehired

That's where I'm kinda confused. It says "S&WB sites".
Were those fittings originally installed/operated by the S&WB?

I'm not sure, but the article states that any excavated scrap is supposed to be sold by the city at auction. This would make it S&WB property I assume

Technically in the end it does, but he had documented it for awhile on the back of the work orders, and his supervisors never told him what to do with it. So he made the effort to give it to them.
I think the appeal got it right, firing him for that goes to far. It's not like he knew they had a policy of saving it and took it anyway... he made the effort to give it to the S&WB

I dont think thats relevant.. they were totally abandoned by them if they were... it would be no different than digging them out of the trash.
ETA: I'm under the impression they were loose fittings found buried... not fittings they were replacing/uninstalling.

It sounds like it. The key here is that the items were surplus from a S&WB work site. EVERY municipal worker knows that anything surplus goes up for auction. It is absolutely ludicrous that this guy would argue he doesn't know better.
Got a new work truck this year? Cool. Take your old one home and give it to one of your kids. Although that is a bit of hyperbole, you have to realize that there isn't some magical cut off line. The items had value and thus go to the city for auction. PERIOD. This is one of the first things you learn when you go to work for the G.
The guy was stealing. He should be fired and prosecuted.

No I think these items were old junk that were buried and he found, not surplus.

You left out some key details in the article. This guy definitely should not have gotten fired, but some of his superiors should be.

The commission heard testimony from S&WB supervisors, including the deputy director of security, Ronald Doucette, who told the inspector general in June 2016 that a process for selling scrap metal had only recently been created. S&WB warehouse manager Alden Aramburo told the inspector general that its investigation into scrap metal sales prompted the new process. He told the commission that it was "rare, if ever" that S&WB employees would return used brass to the warehouse.
"Prior to 2016, warehouse employees would not have known what to do with brass recovered from work sites and would have simply directed field personnel to put it in an unsecured bin designated for scrap metal," the commission wrote. A third manager, Johnny Jones, told the commission that even if field employees did try to dispose of scrap metal for later auction, they would have been turned away. "Mr. Jones testified that when employees under his supervision in the networks division began bringing scrap metal to the warehouse, employees at the warehouse would refuse to receive it," the commission report said. "Eventually, the S&WB secured a dumpster for the scrap metal."

I don't know. I'm kinda on the fence on this one. I think both parties were at some fault here.
