Just to be clear- I am not a lawyer, just married to one.

My point in saying that is every citizen is entitled to rights in this country. They don't get tossed out because some dickhead cop is having a bad day. They don't get tossed when a cop pulls you over. It really speaks to the current state of things that people feel like they need to consent to every LEO demand in fear of getting beaten, their property seized, or worse, when often there's no legal basis for them to.

People should not fear asserting their rights. That you claim it should be common sense to essentially do what they say or else, every time, says a lot.

I would love to know what reasonable suspicion this guy had to stop these teens.

Yeah, or rape cases, burglary or murder. There is a new nationwide law enforcement movement under way right now.

People don't realize how many freakin kids (black and white) ride bicycles through Mall parking lots these days. The new initiative is to follow within a couple feet of their bikes with SUV's until they freak out enough to stop, get out and beat the shite out of them, throw them around by their hair, tase them and then charge them for resisting arrest and assault of a police officer.

Yes. I also don't see a way to screen/train officers to prevent allowing the bad apples become cops. I don't know/understand why cops aren't held to a higher standard and charged/punished with crimes more often. That is on the entire system though...the don't turn on your own shite needs to change.

You'll never get rid of all bad apples but you sure as hell can weed them out.

We really need to concentrate on getting violent offenders off the street and not aggressively pursue minor infractions.

Cop pulls you over for nothing and is being a total a-hole and you think that is a good time to assert my rights? You think that knowing the potential consequences is not something an individual should weigh when dealing with cops? Keep in mind you are already being detained/stopped by an aggressive a-hole and have no idea what is going through his head...and he is armed. Yeh I will comply and try to do everything in my judgement to get him off my back and not be hemmed up even longer than I have to. Sure I will question a cop but I won't flee or be combative...that is just stupid.

I think the issue is the bolded, not with the assertion of rights. Should we not expect LEO to behave in a matter that does not require you to describe them in that way? What about their job entitles them to this level of having the populace feel as if they need to walk on eggshells in fear of angering a hostile armed police officer?

I'm not saying you're wrong...it's certainly smarter. I'm saying until we ALL start to expect better from them, we'll continue to get what we get.

If a cop is acting w/I his legal authority I certainly would allow him to question me. Under Terry, all a cop needs is reasonable suspicion to conduct a stop and frisk.

However, this was Mall Security. Mall Security cannot conduct stops under Terry. They have the authority of a regular citizen.

Some contituional issues arrise re: off-duty actions by law enforcement. Since this guy was getting paid buy the mall, any guise of acting under the color-of-law doctrine wouldn't likely hold.

Hence, the charges getting tossed. The Cop wasn't a Cop (for legal purposes) during the encounter with the girl.

Ask yourself, should privately contracted business security be able to conduct itself in the way the mall security did did. Ask yourself how you would act with a bouncer at a bar. Same type of deal. You should always be able to leave.
