Selling candy for charity and not actually donating the money

Someone I know and don't particularly care for decided it would be a good idea to confide in my their new money making adventure. They are going around to local businesses and setting up boxes of candy for a charitable donation, but they are actually keeping the money and not donating it. I questioned that and they said you actually aren't required to donate it.

What I gather is that they are buying the candy from a company that does this and allows you to manage it yourself. Like an honor system I guess. It's up to the person buying the candy to choose what charity they want to donate to and handle the donations. Clearly, said person is only donating to their own bank account.

Other than being flat out shitty and a pos of a person, are there any legal ramifications for this? I'm uncertain if it's illegal or not and haven't been able to find much online.

Before any of you assume like you love to do here, no it's not me doing this.
Like I said, it's someone I know very well and don't exactly care for.

It's actually pretty clever, because they get to keep the money instead of giving it away to the charity.

I would say if he is selling "world's finest chocolate" brand then most people recognize and reasonably assume the proceeds go to charity. In that case, I would say he is engaging in fraud. But I'm no lawyer.

If it was me, and I'm not saying it was, I'd just buy cheap candy at the store and use that. I'd also, if it was me, sprinkle some cocaine in to guarantee repeat customers.

No, I wouldn't expect it to be much money but they seem to be doing this at several locations. It could add up to be more than I'd suspect, but have no way of truly knowing.

Your friend needs to be careful. Everyone knows that the Eastern European mob controls the "charity" candy racket at businesses. Your friend might wind up with his legs broken or worse if the proceeds aren't going to help the poor in the Ukraine.

I don't hate anyone that earns an honest living. I do have a slight issue with liars and scammers though.

Worlds Finest back in the day used to be $2 a box, like 1992. I remember that being a huge amount of money at 8 years old.

I was just like, man that must be at least $5-6 today.

It's $3.59 relative to today. There is no doubt if I had a kid I'd probably eat an entire box over a month.

If somebody kid is selling it I'd probably just buy a box right out. Chocolate covered raisins and peanuts are my shite dawg.

If they are sold with the representation that the money is going to charity, then your friend is committing an act of fraud.

This is punishable by prison time.
