If it goes to trial, they will put out any possibly disculpatory evidence the judge allows. But it won't go to trial.

See I think it's hard for people to comprehend, and make a judgment call on that context, where there is seemingly a free exchange of the sex, or at least a very low threshold for it. Does that make it okay to do whatever to whoever is around? No, but it's probably the worst environment possible for avoiding sexual assault.
