I’m cool with the driver shooting this guy (not sure WTF kind of gun he was using), but it seems like he could l/should have just driven off instead.

Yeah, no. With a .500S&W Mag, .500 Max, .50 A&E or .50 Gl the chances of causing yourself serious facial damage with that one-handed cross-body shot are pretty high not to mention the hearing loss. I'll accept just what he had, enough to neutralize the threat.
