A "reckless" restaurant owner has been jailed for six years for the manslaughter of a customer who had an allergic reaction to a curry.
Paul Wilson, 38, suffered a severe anaphylactic shock in January 2014 after eating a takeaway containing peanuts from the Indian Garden in Easingwold, North Yorkshire.
Mohammed Zaman, 52, was found guilty at Teesside Crown Court.
The court heard he cut corners by using cheaper ingredients containing peanuts.

Mr Wilson, a bar manager from Helperby, North Yorkshire, specified "no nuts" when he ordered a chicken tikka masala - an instruction which was written on his order and on the lid of his takeaway, the court heard
.
quote:

In what is thought to be a landmark trial, Zaman, of Aylesham Court, Huntington, denied he was responsible but a jury was told he switched almond powder for a cheaper ground nut mix, which contained peanuts.

I don't like this. I know you have to live but you can't rely on strangers to make sure you don't die....You have to be responsible for your own food.
quote:

Zaman claimed he left managers to run his restaurants and that included ordering stock and hiring staff, telling jurors he was not on the premises when the curry was ordered.
Until his conviction, the restaurateur had "the immigrant story to which everyone should aspire", his barrister Alistair Webster QC had said in court.
Zaman was born in Bangladesh and came to the UK aged 15. He started working for his uncle in the restaurant business, finally owning six himself in York and North Yorkshire.
His restaurants won local business honours and acclaim from the British Catering Association and the British Curry Awards, the jury heard.
The father-of-four was found guilty of manslaughter by gross negligence

Yeah, seems like dangerous territory to actually find someone culpable of his death.

How do some of these kids with all these allergies grow up to be adults?

If you are that allergic to peanuts it seems like you'd eat simplified food if that makes sense.

I find that hard to believe that not a single person was allergic to peanuts 25 years ago

Someone else got sick a week earlier from them too because he lied about peanuts in the food, he did nothing, then this guy explicitly asked if there were peanuts and they said no and marked his to-go box "no nuts".

That's pretty fricked up.

Restaurant owner deserves some sort of penalty like a fine or something, but not jail time. If I know that eating peanuts will kill me, I'm not going to put my life in the hands of busy strangers getting paid $10/hour.

Hang on. He owns a business. His employees took the order and ignored the request. He is not liable for his employees actions?

Let's go another step. Shouldn't this dead a-hole know that Indian food is riddled with peanuts?

So.

I get that. Walk in to some 3rd world, English as a second language restaurant, where 80% of the staff doesn't even have a high-school level education and has been in the country less than 2 years.....and put your life in their hands.

"No sir, No Nut in food. We no put nuts in food."
"Is there ground nuts mixed into the thickening agent"
"uhhhhhhhh, we no put nut in food"

I think being jailed for 6 years is getting off lightly if this is the case. Seems open and shut as far as negligent manslaughter is concerned.

You quoted and bolded parts of the article that imply this place was a tip-top restaurant. Now it is a 3rd world joint?

"Oh damn, Mufassa, you must have sprinkled crushed nuts on that no nut dish"
"No, I not do, must have been Mohinder"

Hey pal, a big frick you for calling my daughter a pussy, she is two years old with a severe peanut allergy that could be deadly. It is certainly not her fault and will be something she will have to contend with for the rest of her life.

The dude purposely misrepresented what he was selling to the public, hired illegal workers, and didn't bother to change anything from a prior incident. Zero sympathy for him.

lol, seriously? You think the dude has James beard award winning chefs BOH? These places are the same, just the standards of execution are different. And if this is a trendy metro area, then they want "authentic".

But the purpose of the statement was to say that this dude was "reckless" in leaving his life open to a mistake that can be made by anyone unknowingly.

I mean I get your point, but it's not like the deceased was being careless. He explicitly asked for no-nuts and was told there was no-nuts. That is the threshold that most of us would have as well.
