re: Restaurant adding a ‘3% operating charge’: Why not just hide it in the item prices?

There is a 20% service charge on the bill ($3.20), as well as a $4 tip. That's a total tip of $7.20 or 45% on a $16 bowl of soup.
But also, a "service charge" cannot be a "gratuity". A gratuity is freely given by the customer, like a gift, and cannot charged by the establishment.

Why did you tip on top of that? Is this rage bait?

Send a message by showing up with a bag of pennies. Use that to pay in cash.

quote:I know all about antiquated laws. We got sued by an employee to whom we gave LOA money during COVID. He sued us/called DOL saying we didn't pay him enough hours. Turns out we paid him exactly the correct number of hours.
All over an antiquated law requiring businesses to pay weekly instead of bi-weekly.
The DOL guy told me he had to find something on us do he could fine us to look good to his boss. In 1939, when the Davis Act was created, a footnote defined wages as "average wages." Well, we paid this employee his regular rate and the appropriate OT rate as needed as would any business.
However, the Biden DOL guy said we should have taken all his wages OT and Regular and do a true average rate, which included OT, to determine his base rate. So we had to pay the guy about $300 extra dollars plus a small fine to the DOL plus about $8K in legal fees on my end.
Less Government = Easier to do business

Restaurants have become greedy. Lesson learned next crisis do not be generous as we were in lockdown. I will deduct any service fee from tip. May not be the server’s fault, but I won’t pay 50% more for a meal by tax, fees and tip added.

And the business owners are the bad guys. The employee caused all that damage for $300

You also paid that credit card fee pre-Covid, I’d guess. Now, because of generosity, y’all stick us with the cost of doing business with visa, etc. it’s called overhead, same as with a firm who bills. Some things just can’t or shouldn’t be charged to a client.

Min wage is 22.50 at LAX and you tipped on top of a 3% charge.
You are part of the problem.
I purposely tip less, if at all, in any of the states that have crazy high minimum wages.
They wanted a “living wage” which we all knew would never fix their “problem”. You don’t get tipped out on top of it.
Smh

Why do you so many of you do this?

Those fees have gone up since covid. Credit card companies are taking advantage of people using cards more as well as taking on premium cards

Insurance is going to break so many businesses.
Insurance is pretty much the Mafia at this point. You dont see many cases anymore where someone is like gdamn. Im glad Ive had insurace.
It extorts and impacts every faction of business from health care to operation and makes it more difficult.

Especially in our areas where insurance is the capital improvements budget

This past weekend, I paid cash for some sandwiches at a Monroe, LA BBQ joint that gave me a 3% discount for paying cash.
Probably a better PR gimmick than charging 3% for using your credit card.
At least that's how I saw it.

Eat before you get the the airport, I don't dine out much anymore, I cook for myself, and I don't have to tip or pay the fees.
Posted on 10/8/25 at 12:41 pm to jmarto1
I did once read where they were raising fees and it offsets the cash back reward. Consumers were benefitting and card companies didn’t like that.

The 'Concession Recovery Fee' is a direct charge back to the customer for the businesses airport operating fees and it's taxable!
Good lord, we're being nickel and dime to death. All this plus shitty service is frustrating, exhausting, and flat-out just too damn expensive.
