If that's what you agreed to settle for, then, yeah - that's the "gross" settlement. That should include your general and special damages. They will deduct their fee and any outstanding expenses. You should get a draft disbursement sheet before they actually have you come in - they want all your questions answered so they don't mess around with it at the office.

I'm curious. In LA are you able to get away with cutting the client a check for their part prior to the draft clearing into the trust account? Most firms his size have several hundred thousand floating in the trust account and I have known a lot of firms that did it this way but none of my firms ever did.
Also seems rather stupid from the Attorney's POV to call up with a number over the phone they weren't clear about. I never discussed any settlement offers unless they were in person and with numbers on paper people could see, too much to get confused about and blow up the settlement.

It’s been over a year, maybe 18 mos, and that’s without having to go to litigation. Went to one attorney and she told me it wasn’t worth pursuing. Took it to Spencer and he got it done.

atty takes 40% fees and expenses will run anywhere from 10-20%- client receives balance

I cannot address LA as I am only admitted in DC, VA, and MD. I just found it odd when I read the OP because I had the feeling that the lawyer had never spoken with the OP about the value of his case and now OP hears his case is settled. That’s strange to me.
As to escrow accounts, that’s one area that no lawyer should mess with. Here if an escrow account doesn’t balance or a check bounced, the lawyer can kiss his license good bye. It’s the death penalty.

Ok we first went to the attorney for my wife’s accident about 6 months ago and just got a call at the beginning of the year saying they have officially filed the suit with the other persons insurance. Sounds like we shouldn’t expect anything for at least another three months.

With the client volume Callahan likely has, speaking in person about every settlement probably isn't all that easy if he is trying to be timely.
