Back in my younger days I refused to blow once.

Paid a lawyer $1k and walked away with a non-moving violation and $250 fine.

Best $1k I've ever spent.

I think that is the general consensus, not blowing and obviously not doing the field sobriety test either. If they already are going this route they figure you are already impaired so why give them further ammunition to use against you. Also don’t say anything dumb to incriminate yourself like I only had 1 drink.

You don't know how much power a DA wields do you? You can arrest anyone for anything, but if the DA chooses to not prosecute, or allows for pre-trial diversion, then there is nothing the police or judge can do about it.

If you refuse to blow you get an automatic one year suspension.

The cop will testify you were drunk and you're going to go down for the count anyway.

Sure the DA has prosecutorial discretion, and may offer you PTD. Does that change the law? You think DA's are running for ofifce on "we give drunk drivers a get out of jail free card" platforms, and handing them out like candy? No . You're gonna have to plea and hope you get an 894. Do you have even the slightest clue what happens to your insurance if you get a license revocation for refusing to blow?

Way to take that to the next level for no reason. You crack your window so he can’t claim he smells alcohol. You cooperate as much as possible without giving them anything. Then refuse any test and go get booked and have somebody pick you up. I think that’s what he means. The cop isn’t breaking your window unless you are uncooperative. What’s the reasonable cause to break your window? This would all be on his body cam and Delatte would pick that apart

Eh, while that is certainly plausible it is not definitive.

In my case as described above, it went up a bit but nothing crazy. Much better than what would've happened if I blew and got a certain DUI.

A huge reason to lawyer up isn’t always to get off.

I guess it all depends if you are in a rural parish or an urban one. Rural parishes are different.

You are factually wrong. If you don’t have any prior dwi’s and don’t blow you can do a pre trial diversion if DA accepts. I’ve seen it happen many times in real life. The documents you cite are law but not always used.

You have to lawyer up. Because this is the only thing in America where you’re assumed guilty and have to prove your innocence. One year suspension if you don’t blow?! That’s so f’in unconstitutional it’s insane. . No due process, just punishment without even being found guilty of a crime. It’s so backwards. Blah, blah, public safety… I don’t care. It’s such a violation of people’s rights.

And you never, ever take any of the tests. If you do, you’re going to jail. So you may as well not assist the corrupt cops that are trying to jam you up anyway.

I’ve had several high profile attorneys tell me this. One even said he could get anyone off as long as they don’t blow. But it’ll cost you 10k or more.

It’s not worth it, just take your pre trial probation and be done.

Nope. What I said was right. If you have the hearing and win. Your license gets reinstated and you don’t even need a hardship license for work. You still have to deal with the criminal charges. Your suspended license is a totally separate issue.

It’s only if you lose the admin hearing, and like the other poster said that’s obviously a lawyer, you can appeal that. You have to file paperwork with a real court and go before a real judge.

Trust me I’m an expert in this field. I embarrassed a seasoned state trooper that tried to arrest me one night. Even he didn’t know certain laws.
