Yep, and taking the left would put you at fault.
If you are in a right lane and slow down to turn, and it is a passing lane. Common courtesey would be to let the guy pass FIRST by the Texas pass. You pull to the extreme right of the road, signal intent and then stop for your turn. At this point you let cars pass.
I never see this outside of Texas country roads, but it's the best way to allow someone to pass.
If you were turning and traffic was stopped behind you as you were waiting to turn and as soon as there was a window a guy in the left lane passed, then he is at fault.
But if it's a passing lane and you turned into a car that was actively and legally passing you then you are at fault.

Everybody is glossing over that he was going WAY over the speed limit and passing in a no-passing zone that is specifically marked because it's a neighborhood and people turn there every day. I'm not sure why everybody is ignoring the most critical legal fact here.

If the truck occupied the left lane before u turn left the turning vehicle is at fault.

If you were sitting still your perception of speed might be off. I don't doubt he was speeding on that road though.

At what point does an action become so unbelievably reckless that a normal person obeying the laws could not be reasonably expected to anticipate it?
A little voice told me he might be that suicidal, but there is no way a 16 year old kid or your grandma could have been expected to have anticipated that. I was just really lucky.

Nope. Preponderance of evidence. One party was behaving reasonably and the other wasn't. The skid marks of the truck and the eyewitness testimony, in combination with how the road is posted, would tell the tale.

If it were a crash, there would be know way for the investigator to know he was going 25 mph over the speed limit. Unless it was a fatality or serious injury involved, I doubt the insurance company is going to call for a re-constructionist to determine his speed.

And? If passing is allowed on the two lane road, the left turner has to make sure the lane is clear (in both directions). Sorry, that's the law.

This is 100% true. Now if the vehicle is passing in a no-passing zone, that's different.
