I this situation, there is absolutely no scenario where the OP would be in fault making a left turn on a two lane highway when someone behind him is trying to pass and collides with his vehicle. Deal with it bro.

OP would be breaking the shite out of the law

Had the same thing happen to a buddy of mine, never would have thought it, but he was at fault.

If it's a no pass zone then I'm not sure. Wouldn't doubt he'd be at fault there too though.

Driver of the truck says he didn't have his blinker on, or not on very long and that he took evasive maneuvers.

OP says:
quote:

It's definitely a no passing zone with a double yellow line right there where those neighborhoods are.

Nice link bro!

La drivers handbook page 34

Double solid yellow lines = no pass, but it does not prohibit turn.

Sorry bro.

I was hit on hyacinth by an lsu basketball player in a fancy 300z(this was in 1996). He tried to pass me as I turnt left on to Hood. He got a ticket and I got about 1700 for a dent in my pos car. I'm sure it was no passing zone but just an FYI.

More detail-I'm on a 2 lane hwy (south walker road), going maybe 5 miles over the speed limit , starting to slow to turn left into subdivision on left with my turn signal on, truck comes up behind me doing maybe 80 in a 55,and passes on the left. Had I not anticipated it, he would have hit us broadside and killed me and four kids, and himself. As it was he almost hit a truck coming the other way. Single dumbest Darwin-testing human I have ever seen IRL.

He didn't say he was driving a truck but he did say he had his signal on. Where did he say he took evasive action?

Cop in my wreck told the basketball player It didn't matter if I had blinker on (I didn't) because it was no passing zone.

Yep, double solid yellow lines. No passing.

Why do you hate LSU Basketball?

when the law disagrees with you

I figured it was common knowledge that a left hand turn is viewed as a dangerous maneuver and the left turner has a certain amount of liability.

Passing on the left in a "no-passing" zone at 25-30 mph over the limit as people are lawfully attempting to turn left into a high-traffic residential neighborhood WITH THEIR FREAKING TURN SIGNAL ON and almost killing multiple innocent people is the violation.

Observing traffic laws is actually still legal in all 50 states.Go figure. Now I can't say how you see it in Bizarro-jacked-up-jeep-world where legal turns into neighborhoods are "dangerous maneuvers"....

If I had not seen him coming up on me RECKLESSLY AND NEGLIGENTLY at 25-30 mph over the limit and passing illegally on my left this would have been an entirely different thread. Thankfully I made an adjustment for his idiocy and nobody got hurt. But make no mistake, this was ENTIRELY on him. He had no regard for anybody's life, including his own.

Good night folks.

So have we established what the law says yet? If it says the OP is at fault that's the dumbest thing I've ever heard. Is he supposed to anticipate the guy behind him passing him and not turn or something? I thought the person behind was at fault for 99.99% of wrecks.

If you are turning left into private property, the vehicle behind you has the right to pass if it is not a no passing zone. Since the poster was turning into his subdivison, the vehicle doing the passing would have been at fault if an accident had occurred. The private property part is what makes the difference. 20 years ago, we called it the "Clear the Rear" law.

Double yellow line, two way = no passing, but turning is okay.

He wouldn't have gotten the ticket, how do I know this? Same thing happened to me, except I got hit (I wasn't driving). Car flipped twice, guy tried to run, cop was coming out of the same neighborhood, chased him down. Some red neck white trailer trash.

I escaped fine, person in the back seat had a broken leg, broken arm, and needed to go under surgery to repair knee.

Person passing on the left has possession of the lane first and therefore has the right away, person turning would be at fault

Who gets ticketed has very little to do with insurance company investigating and assigning fault and partial fault
