OT legal. Entering Canada with DUI charge but no conviction

Trying to enter Canada flying. My court date is after so I won't have been convicted or pled down or exonerated. Am I good?

Try not breaking the law and putting others lives in danger and you wouldn't have to worry about these things.

Why would you try to leave the country before your court date?

Isn't that like frowned upon?

50/50 shot.

You may want to call them, but they could shut you down over the phone, you could get there and be sent back or they can let you in. I've seen all three.

Risky, but might be good. I wouldnt mention anything, you arent guilty yet...

Not a lawyer but it shouldn't be a problem you have not been convicted of anything and if it's your first DUI it's a misdemeanor anyway. Plus, how would they know from scanning your passport that you have a pending court date for something like that and you haven't been told not to leave the country? have fun!

Being accused is not the same as being convicted. Maybe call the Canadian consulate here in the US and ask them.

Are you currently on probation?
Has a judge ordered you not to leave the country, as in surrender your passport?
Are you currently on parole?

If the answer to these questions is no, then I don't see what the problem is.

But it is a felony in Canada:

In order to enter Canada with a DUI conviction on your records, you will either need to be deemed “rehabilitated” or granted a temporary resident permit. A person is deemed rehabilitated if he has no criminal convictions for a minimum of 5 years after the completion of the imposed sentence.

Yes, they check it via FBI database and it wont be logged at that time, but generally speaking they are letting more and more people in with only one DUI, it really depends on the border agent

When it comes to entering Canada it might as well be. Hell if you have ever been pulled over and the officer investigated you for a crime they are gonna bring it up, even if they let you drive away. They have crazy access to all of our police records and don’t let anyone even kinda shady in...if you have a DUI good luck. OP should google it and see what he can do beforehand because there is a VERY real chance they will turn him around at the border.

i was banned from Canada because of basic thuggery for a year or so and even got rejected on my first application for reentry
