OT lawyers.....

So I'm in NW Arkansas last weekend and a guy rear ends my brand new truck. Damage is minimal... he actually hit my bumper with the sidewall of his front tire.... no scratches and pushed the bumper in about a half inch on the right side.
So he is driving a company truck for a big construction truck in that area. The guy hands me false registration and insurance info. Then he leaves the scene. The trooper finally arrives and they have pulled him over and ticketed him for leaving the scene. Gives me his actual name and address.
My question is, do I bother trying to go through the guy to get it fixed or should I contact the company he works for. We have pics of the truck with website and phone # as well as license plate #.
I have a feeling that they guy is here on a work visa and may not be fully insured but the company should ultimately be responsible if they let him drive one of their trucks??? right?

They're almost certainly responsible for their employee's actions on the clock, but to know for sure you should contact some random guy you see on a billboard out there. They all give free consults (or they should).

The insurance follows the vehicle not the driver.
Just use your insurance company to deal with it, that is what you pay them for. I have never dealt with an at fault insurance company on a personal PD claim.

When the cop pulled him over, did you get the valid insurance info? If so, contact their insurance. If not, contact the company that owns the truck he was driving. The insurance should be under the company's name if he was driving a company vehicle.

And even if he wasn't on the clock, if they gave him authorization to use the truck, they still may be liable.
Ultimately, the answer is: make a claim with both insurance companies. They'll figure out coverage and/or pay it out to settle the claim.

Get an estimate before you think it isn’t going to be expensive. You may need new bumper, mounts, crush box, etc. You don’t know until someone gets up under there and looks.

No. Try to file against the at-fault's insurance first. Only go through your own insurance if the other at-fault driver's insurance is giving you a difficult time. If you file against your own insurance then you're going to have to come out of pocket with your collision deductible, which would eventually be reimbursed once your insurance subrogates against the other driver's insurance. I'd rather avoid having to come out of pocket unless I have to.

First, I'm sorry about the severe and persistent headaches and soft tissue injuries you have experienced. I hope you follow up with as many doctors, chiros and specialists as it takes to return to as close to 100% as possible (knowing deep down you will never be the same). I'm also sorry about the affect this accident has had on your livelihood and marriage.

Yeah if I wanted to be a prick I'm sure we could get paid. It was snowing and all that crap and the dude obviously had no business driving in those conditions.
