One driver's word against the other driver with no witnesses and you can't determine from damage on vehicles exactly what happened then I would say 50/50 is about the only call the insurance company can make. Louisiana is a shared negligence state which means each party can be assigned a percentage of negligence versus all or none.

God, this reads like every client story ever. Unclear problem, information that on the surface appears cut and dry, angry guy who hasn't explained what the issue is, etc. Classic.
Were you sued?
Did you sue?
Did you make a claim on his coverage and get refused?
Did you make a claim on your coverage and get refused?
It all appears to be right there in the police report, but the OP doesn't even establish what the problem is. This is why lawyers don't do this for free on their off time.

police report doesnt determine 100% of fault with insurance. police are lazy with non life threatening traffic investigations

A police report and/or ticket alone does not determine negligence. You may break a law and receive a ticket but that does not automatically mean you are 100% negligent in a situation. Under your scenario if no one receives a ticket does that mean no one was negligent?

Do you have collision coverage on your vehicle? If so isn't the cost of an attorney going to cost you well more than 1/2 of your deductible? I couldn't imagine an attorney really even wanting to spend time on a small vehicle damage case with no injuries and both drivers having different versions of the way accident occurred.
