As far as your record goes it isn't clean anymore simply because you were in an accident no matter who is at fault. Underwriting ultimately decides if your premium increases simply due to being involved in an accident but your agent can probably help you out with that question as well

So if I get hit by a drunk driver, my rates may still go up even if this loser POS had some 1/2 arse insurance that paid the claim?

This sounds very avoidable by 2, but this board is generally pretty lax about that. (Shocker, I know).

Can't really tell by your description, but it seems as if 2 could've braked better and/or used the steering wheel better.

Still, 1 is an idiot that can't turn.

75%-1, 25%-2.

My bet is 2 was talking on the phone, but I doubt I'll get an honest answer.
. Lol, all I can tell u is she swears she wasn't. She almost did avoid it. But she didn't. That's all that should matter

from the video at least 80%, maybe all the way. Traveled about 50 feet or so in at about 10mph

Understood.

That's why I said it sounds like it could've been avoided with a little more anticipation.

Sometimes you can't. S... happens.

#1 is at fault and their insurance will eventually pay it in full.

Has anyone said #2 is at fault.

Car 1 is the at fault vehicle.

Who the hell makes a right turn from the center turn lane?

Car 1 is at fault, they should have yielded as they entered from the turning lane.
