If it can be proven that TS accelerated then he should face negligent homicide charges. We will need video of all events leading up to the collision to be able to determine if he was following cautionary protocol that is expected during these events. If he did indeed accelerate causing his back end to fishtail then he better have a good reason for it, otherwise he was toying with the kid thinking he would throw a little mud on him. I believe that was what was intended and his horseplay on the track led to a kids death. He was negligent.

In my experience, solely accelerating is not enough to warrant negligent homicide.

For negligent homicide, you would have to prove that TS accelerated and intentionally steered his car toward the guy in an act of negligence.

Without an admission from TS it would be impossible to prove any intent on TS' behalf.

There was an unknown number of cars on the track with some passing right near the camera. If you can tell us for sure that the engine you are hearing belongs to Stewart you will impress the most expert amongst us. There is a job for you someplace with this kind of gift/talent.

There are a lot of people in this thread with opinions but no experience from which to back up these opinions.

Watch the video one frame at the time. Remember that these cars are relatively light. Look at the position of K.W. as T.S. gets near. Question: Is that a swerve toward K.W. or the car being jerked to the left just as it makes contact with K.W.?

The video can also play with your eyes some because this is coming off the turn. Unless there is in car footage to show active movement by Stewart to mow the guy over, no way Tony won't get the benefit of the doubt and this will be just an unfortunate very avoidable incident.

With that car two cars in front of Stewart being high in the turn as well and not too far in front of him, Stewart's view may be very much blocked until right before the incident.

Also if you play the sound of the car accelerating backwards you can easily here Stewart say "Paul is dead".

You know who was actually negligent? The ding dong that got out of his car and get in the middle of a race track with cars on it.

If the single report that stewart might have been tying to do a mud throw om the guy was never releases, no one would even be talkjng about that as a possibility. Thats really hard to do esp. On a target that you cant see for until last second. But people hear it and run with ut.
Considering a mud throw isnt a common thing (grew up on dirt racing and never have heard of this move to do to someone standing) .so stewart had to come up wit a new plan, ignore all other cars on cool down lap, know the kid was going to almost get hit by 45, then try to plan his new trick.

There's a swerve but in this video it's looks like he may have seen the guy late and swerved to miss him.

I'd be interested to know if they were running radio/spotters to see if Tony was alerted to the guy on the track before he got there.

If they didn't alert him, he may have only had a few seconds to figure out what to do with the guy on the track. No way he had enough time to think to do something as crazy as throwing dirt on the guy.

And for the record the only swerve you see on the video is after TS hits him.

Without view of what TS does prior to hitting him all of this is just speculation.

To me, it looks like TS is trying to go around him but the guy keeps moving into his path.

But again this is just speculation.


In the end the fault has to be put on the guy standing in the middle of a race track.

this, the only "swerve" I see is when he is at the point of contact, and that is away from the guy standing in the middle of a mud track.

Most dirt tracks run no spotters.

Tye top late model class on dirt (use to be hav a tampa not sure name now) run spotters but thats bout it.

I know the bayou sprinters dont have spotters and I cant think of Ne sprints thT do
