OT lawyers: Insurance company is screwing me

An elderly man hit my wife's van on the back panel, which caused the sliding door to move toward the drivers side door, damaging both the sliding door, and drivers side door. His insurance will only repair the back panel, claiming the door(s) damage was existing. To make matters worse, the body shop that repaired the back panel took the chance to "help" me out as they call it, and hammer both doors to make them close. Am I fricked? Both sides are playing dumb now. The damage is enough to notice, but I am not sure enough to hire a lawyer (I would estimate $500 to repair). TIA.

You should probably get a real estimate. Body work is expensive.

The orginal estimate took into account the door damage. Delta was ~$500.

I'd let your insurance company know. Tell them you will be submitting a claim and they can subrogate to his insurance company. Not 100% this will work, but that's where I'd start.

It is State Farm, mine and the guy that damaged my property. I have never been with another company. Never missed a payment. That is what pisses me off the most. They are good at taking money; not so much customer service.

Go talk to your State Farm agent rather than an attorney. He/she should go to bat for you.

Speak to your insurance company and let them deal with the other insurance company. You will get your car fixed.

Best advice I can give is to call and make a stink about it and let them know you will be leaving State Farm for the way they've handled this. It's your agent's job to deal with claims specialists.

I when thru this before. Had a guy ram me at a red light. I was towing boat. Little damage to my truck, but the boat had a shite load. After claiming, they didn't want to pay. I was like WTF? The guy that ram me had SF, as I did.
Had to lawyer up and then they paid plus lawyer fees.

Just so you know, being a good customer means nothing for the claims process. The coverage is based on your policy and their standards. One of the quickest ways to annoy your adjuster is to say thins like that. Be nice and keep them in your corner.

Yup, unless you have a ridiculous amount of policy with them, being a good customer means nothing. The only real thing that affects an adjusters are escalations to their supervisors or insurance commissioner complaints. Sometimes agent pressure helps

Not saying the OP hasn't been nice, but being nice goes a long way. Doing things like demanding stuff from them (or any other customer service person) only irritates them.

Doesnt matter. Your policy only covers so much/certain things.
At no point have you said anything about what your insurance company has said. Did you even contact them? You cant complain about them "taking your money" if you dont speak with the adjuster and find out what is going on.
Also, when you talk to them dont be a dick. They can really help you out or they can make things difficult. Up to you how its handled.

agreed, but sometimes adjusters get to reading a script rather than thinking about something, and you need to get authoritative. Crawford Claims is the absolute worst at this

I am claim specialist but I'll keep my company's name out of it. As a CS, I'll tell you it's not the insurance company that's screwing you, per se. You really only have one option:
1) You have to get the estimator to agree that the damage is related. That call is completely up to the person writing the estimate. The insurance company is bound by the policy to pay for ALL damages related to the loss
The CS's job is to pay the claim as it is submitted to them by the estimator. The CS is not actually viewing the vehicle and has no training in estimatics.
As for hiring an attorney... It is a misconception that this will get you anywhere with your claim. Your attorney is going to drag out the entire claims process and ultimately you will end up right where you started with a 1/3 of your benefits going into his pocket. Most CS's would prefer to deal with an attorney because they have been down this road time and time again and know what to expect. As for getting your agent to intervene... once again a misconception. The agent is independent of the company and shouldn't have any bearing on how the claim is handled. The agent's primary job is to report the claim and inform the policy holder of their options and obligations... And yes I now realize that I am hated as you all now know I work for the big bad insurance company. Good Luck!
