Letting your carrier fix the repairs will get your car repaired. Minus your deductible.It is then up to you to after your deductible from the responsible party/carrier . However, in order for your claim to be closed, you have to sign a release/settlement. As long as their claim is open, they have to keep reserves posted on it to cover any anticipated costs. Work out the best compromise you can. With the amount involved here, an atty would only cost you more in the long run. IF you can get an atty to take on a case this small ( to them )

Purely based on your negotiating skills with the dealer. Dealers are quite aware that diminished value does not really exist if the vehicle is repaired to pre-loss, factory standards using OEM parts. That is why only one state in the Union actually factors DV into their claims. Unless your vehicle is a 2016 that was just driven off the lot, you really don't have a DV claim unless the shop used non-OEM or recycled parts. The car fax reports are for the buyer, not the dealer.

Thank you for the post. Looks like I will have to chalk it up as a learning experience. The guy who hit me, his insurance adjuster claimed it was pre existing, and I am pissed I have no way to argue the fact. Also, as you said, my agent really has no role in this. I was ignorant to this, and assumed paying my insurance payments on time for years and never having any claims on my account somehow added value. It doesn't. Moving forward, I will shop my insurance needs out to get a better deal. If it will be a hassle using it, might as well get the best deal. I felt I was paying for costumer service, piece of mind, etc, as dumb as that sounds.
