There is nothing in the FARs about flying a drone over private property and shooting it down. In Part 107 it does state: "Small unmanned aircraft may not operate over any persons not directly participating in the operation, not under a covered structure, and not inside a covered stationary vehicle." It's a local law enforcement issue and, if you know the person flying the drone over your property, you will have to report it to the Police or Sheriff's Department for them to investigate.

You physically can't shoot it if it is high enough to violate airspace of 400' AGL. If it is low enough you can shoot it, it is in unrestricted airspace. Also you don't own any airspace, so as long as the drone is not physically touching part of your property, it is not trespassing.

Pretty sure it is against the law to shoot down a drone. They are treated just like an airplane.

They have the right to your “airspace” just as much as a traffic helicopter or a 747.

This

Drones are registered with the FAA. The FAA registration number is/should be clearly marked on the drone.

Shooting one down is looked upon buy the FAA and other official agencies as a felony. So by all means, feel free to shoot one down. Just make sure the kinfolk send you lots of KY while you doing your time.

(FWIW I despise arseholes who misuse drones and who legitimately invade peoples/neighbors privacy. Mind you a drone flying at 100 ft is not going to be able to see you laying out in the backyard in your thong. Not that anyone would want to. But there is a huge difference between someone flying one over the neighborhood 100 ft and some idiot who gets his kicks off of bugging people by flying it literally into their back yards)

The best legal answer would be one having legal precedent. OT is slacking today. I fly all the time >120' and most neighbors have never seen or heard my sizable fleet buzzing about. Above 300' and its a speck in the sky.

"The 80 foot rule comes out of a trespassing case. 83 feet in height was defined as 'high enough' to not be trespassing."

Any diffrence betweeen a drone, kite, hot air ballon, Cessna, ultralight, etc? Of course you can not shoot it down
