Key word being shared. I attached the deck to my side of the fence.

How can it be shared if it's on her property? Key words being "her property"

How is it my problem that the developer put the fence in the wrong place?

Do people actually fight over this shite, damn dude she's ninety. Give her the benefit of the doubt and telling on someone without trying to speak to the other party is bitch move 101.
I am sincere when I say this, but time on this is time misspent for you because you are poor and need to concentrate on unpooring yourself and less on messing with a soon to be dead poor.

Has she said "get off my lawn" ?

Seriously I think you're making too much out of this.

Definitely not poor. Sorry.

Back story is we did approach her and asked what the problem was she said nothing. Her daughter called the HOA and got them involved. She reported us for the fence we built which was approved. The deck we built which was approved. I removed lighting on that side of the house in case that was what was bothering her. We made every attempt to be civil and they brought it to this.

That's why I'm asking for my options now, not in the past. I'm not a bitch and I attempted to resolve this with the neighbor directly and they wouldn't hear it.

If it was me, instead of stirring shite up i'd take down your old arse fence pickets and replace them with new pickets that are just as tall as hers. Then you won't half to see her workmanship and they're only $1.50 a piece.

That is an idea that crossed my mind but technically it's against the HOA to have anything over 6 foot.

How did this turn into me being poor, OT gonna OT.

No I did not build that old arse fence, that was built with the houses during construction. Below is the fence I built on the back and other side of the yard.

For all the yard looks like shite folks, flame away.

Why does the wood look 30 years old already?

Tough break with the old neighbor. She can die any day though.

OP is giving the old lady a reason to get up erry morning.

It's bad gris-gris to mess with ancient folk, wait till she croaks. Winters are particularly tough on nonagenarians. The worst case scenario in this whole deal ain't particularly bad for you.

PS: Your lawn looks like what a green Chewbacca with mange would look like if it got run over by a steamroller.

It's 3 years old and gets a shite ton of sun. Have put any sealer or anything on it yet.

I honestly don't care how long the bitch lives I just don't want this shite to drag out when I'm selling next year.

Well she is nice, the daughter who has handled this whole thing is a mega count.

seems like to me if that is a shared fence and it was built with one foot of her property on your side, and she has no access to that one foot, that is your one foot to do with as you please....unless she takes down the fence and puts it on the actual property line...like it should have been built originally.

By the way, I bought a little bit of a fixer upper in New Orleans. If that fence bothers you, you'd lose your mind at my property. Fencing is all fricked up. On the list of things to do.

I still don't get why you're complaining about her fence. Plant something in that yard. It's pretty bare. Her fence is nothing. She's 90. Now, you've got more problems because you complained about her fence of which you can see 2 feet above the original. Like I said before do something with your fence so it looks nicer and ignore hers and live on.

Got to zealously defend your property rights, or you'll end up like W's Family LLC.

beta move to complain about her fence ... there are any number of things you could've done to hide that "hideous" 2 feet that apparently keeps you from enjoying your grill ... now you have brought your property line into it ...

karma's a bitch ...

I agree somewhat gris, except I am selling soon and don't want to unload more money into this place I can put on the next. Plus I shouldn't have to. The first time and only time the daughter approached me I told her I was more than willing to do whatever was necessary for them to "repair" the fence. Which is what she said they needed to do. I even offered to help. The next day they built that.

It's 10 feet tall by the way.

I might just paint it green and put 300 on it to look like Boston.
