OT criminal lawyers question

We had an employee embezzle a significant amount of money over several years. They were arrested and the case is now going through the 19th jdc. Their attorney is wanting to negotiate a plea bargain and one option being discussed is house arrest but they say there is an affordability issue on the behalf of the defendant and still maintain being able to pay restitution. I’ve researched on line and the amounts are all over the board.

No. They are saying that for them to be able to pay restitution that any cost for home monitoring would reduce their ability to pay back the money stolen. Obviously they are just trying to get out of house arrest

I don’t know or care about the answer to your question, but would it not seem logical that any money they were charged for house arrest monitoring would mean they have less money to pay you back with?

That should be their problem. They stole the money in the first place. Work extra or go sit in jail and pay it back when you get out.

I'm not an attorney but that sucker would have house arrest and it would just take a little longer for me to get all my money back. Frick a thief.

The charges are the state against the defendent. As a victim we do not have a lawyer.

you'll never see restitution then, better to stick them in jail. at least give them a record that will keep others from trusting them again.
