Was given a ticket for failing to move over for an emergency vehicle. The trooper was in an unmarked challenger, and funny thing is about 6 miles before he stopped me, I moved over when he was on the shoulder with no lights on and no one stopped. He then proceeded to pass me and went park in front of another car another trooper had pulled over. I was pulling a trailer and slowed to pull over, but as I slowed, the cars next to me slowed also. I never could get over, and when I pointed this out to LSP, he said well you did not reduce your speed enough. I asked what exactly is that speed and he said it was not a exact number. I figured I was doing 45 in a 65. I honestly am not paying this ticket without going to court. I need some advice on how to get dashcam footage. If I lose, then I will pay the fine and court cost. This is not about the money. This is about some arbitrary number the officer gets to make up. I am a law and order, follow the rules guy, but this is a little over the top for me.

Cops run snares around those stupid laws pretty frequently. Amazing how well-enforced the laws that are designed to make their lives easier are.

Still wondering about my bike, though...

So you tried to get over and couldn't? I mean .. what did he want .. you to ram the vehicle in the left lane?

And I would think that it would be "natural" to slow down with a trailer when you're in the right lane and there are vehicles pulled over on the right shoulder.

Good luck and I hope someone can help you. Arbitrary tickets are the worst.

You nailed it, they may reduce it to something else but will just make you pay that and court costs and you will waste a day in court.

This sucks because I believe your story but it doesn't matter how many upvotes TD give you, its the LSP word against yours and yours will rarely win in court. Good luck though

Can confirm. I went to HS with a guy who was executive director of the state trooper association for several years. He went to prison for furnishing his house using association funds, among other things.

They should be out there with massive enforcement efforts of F890s and other related asshats using the left lane as a leisure lane.

I hate shite like this.

Was riding with my boss in a rental car for a work trip once on I-10 W just past the new bridge in BR. There was a group of state troopers on the shoulder parked there for no reason other then to pull people over if they didn't get over. My boss couldn't get over due to cars in the left lane, so he reduced his speed by at least 30 mph.

I guess that wasn't enough because one of the troopers they had standing there about 100 yards down the road pointed at him to pull over. He somehow didn't get a ticket though. He got kind of upset and explained to him how it was a rental car and we were LSU students and employees going on a trip and the officer let us go.

LA LEGIS 32:125

It just says reasonable speed in the statute.

quote:

B. When any vehicle making use of any visual signals as authorized by law, including the display of alternately flashing amber or yellow warning lights, is parked on or near the highway, the driver of every other vehicle shall:

(1) When driving on an interstate highway or other highway with two or more lanes traveling in the same direction, yield the right-of-way by making a lane change into a lane not adjacent to the parked vehicle, if possible with due regard to safety and traffic conditions. If a lane change is not possible, the driver shall slow to a reasonably safe speed.

(2) Maintain a safe speed for road conditions, if unable or unsafe to change lanes, or driving on a two-lane road or highway.

C. This Section shall not operate to relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the highway.

D. Any person who violates the provisions of this Section shall, upon conviction, be subject to a fine not to exceed two hundred dollars.

Acts 1962, No. 310, §1. Amended by Acts 1980, No. 160, §1; Acts 2001, No. 583, §1; Acts 2008, No. 429, §1, eff. June 21, 2008; Acts 2008, No. 746, §1.

Unfortunately, "reasonable" is what the Trooper thinks at the time he determined he had probable cause. Your guilt of innocence is ultimately what the judge thinks is reasonable. The dashcam will be available upon motions for discovery.

Cop was a dick to write that if your story holds true. I've never heard of anyone actually getting written for this.

Just another reason I LOVE living in Georgia. Unmarked cars running traffic enforcement is illegal in this state.

This is exactly where their former superintendent should be for all that he stole. Instead he was forced into retirement. What a punishment...paying him for not working. The whole system is a joke.

I believe it is here too.

They've gotten around it with "ghost graphics" like this. It's total chicken shite.

It's time some of you realize police are not your friend. They don't care about you or your safety and are only here to steal money.
