Very familiar with cost plus fee (fee basically equaling profit).
What I'm not doing is paying upfront or getting myself into a situation where a supplier puts a lien on my home because the contractor never paid them as happens in FL a lot. Big case with FL AG right now to block foreclosures on multiple homes because of a shady roof contractor not paying suppliers.

They just gonna have to cut back on something else in the house build. They may get some of that one day, but it won't be worth it building a house.

Oh, I know. A long-time TD.com poster fricked me over after Hurricane Laura. The house was fine until it came time to settle and pay me, then he bought a new truck and decided to make up excuses not to pay me.

Well it's apparently not available to be refunded. And they are scrambling to transfer assets. So I'm guessing it's not a simple clerical problem.

Report it to the Sheriff/DA/AG if the contractor has not fled the state. Buddy of mine had a similar issue where he paid a contractor up front to do storm restoration (tree went through house and it was a major loss). Contractor dragged his feet and did not finish the work and eventually left the state. My buddy is personal friends with the Sheriff and he told him if he was in state he would catch him and throw him in jail but he had no jurisdiction out of state.
Interesting side story, the contractor also 100% stiffed some Mexican roofers. When they found out where the dude was their response was "we dont need no lawman to get our money..."
Long story short my buddy never got his money back (~$150K) so dont let them out of sight without filing charges on them.

Good subcontractors are awesome people. Charge a fair price, or a slightly inflated price, but the work is solid and they are honest about everything.
Bad subcontractors will rot in hell, if there is one.

Usually for the case to be criminal they have to prove intent to defraud. That may be difficult given the situation

Pretty sure they are still responsible even if in another name. If you’re older and want to keep nursing homes from getting all your stuff you have to have put it in their name like 3-5 years ago or it can still be touched.

If they moved money out of the LLC to the family in an attempt to hide or redirect money, that is not allowable. Big no-no with the IRS. A decent lawyer that works with a forensic accountant can snuff that out in no time.

Call the State Bar for a referral.
When you contact the attorney they referred you to, ask for a consultation.
That attorney could end up being intrigued enough to take the case. The fees could be worth it.
