Officer Who Arrested Utah Nurse In Viral Video Is Now Under Criminal Investigation

Salt Lake County District Attorney Sim Gill ordered a criminal investigation Friday into the actions of Detective Jeff Payne who aggressively arrested nurse Alex Wubbels on July 26 for refusing to draw blood from a severely injured patient.

Payne has been placed on administrative leave, The Associated Press reported. The Salt Lake City Police Department also said Friday that two of its employees have been placed on administrative leave while the investigation is underway. It is unclear if Payne is one of the employees mentioned in the agency’s statement.

Wubbels explains she is simply trying to her job, telling the detective “three things that allow us to [give blood samples] are if you have an electronic warrant, patient consent or patient under arrest, and neither of those things … the patient can’t consent. He told me repeatedly that he doesn’t have a warrant and the patient is not under arrest.”

The footage of the arrest shows Payne interrupting Wubbels as she continues to explain the policy to him before placing her in handcuffs, which causes a brief scuffle between the two.

The video, made public Friday, sparked a wave of criticism over Payne’s confrontation with a nurse who appears to be following hospital protocol.

The Salt Lake City PD is probably going to end up paying millions of dollars to settle. How can cops be so stupid, especially when he was wearing a bodycam and it was on?

The nurse is not suing. They showed her on CNN today saying that she is not filing a lawsuit.

What's the law? Did he act professionally? No. But there was an accident with a fatality involved. The longer the patient goes without the lab draw, the longer drugs/alcohol have to metabolize out of their system. I've seen it done here on unconscious pt's. No issues from nursing or administration. I wasn't directly involved, but I have wondered what the exact protocol is.

Yeah. He was NOT a suspect in the wreck. The person who caused the wreck died.

I don't recall the original story exactly, but I don't believe the patient was responsible for the accident, only involved in it.

The quote clearly explains the protocol. She was more than willing to draw the blood if he followed the protocol/law. Place patient under arrest, or obtain a warrant. Without these things, she acted in accordance with the law and her duties as a healthcare professional.

I don't know the law but the constitution is pretty clear on this issue and the cop is wrong.

No doubt the cops wanted to find something in this guy's system so they could shift blame.

You've never worked in the ER have you? When in doubt, you are supposed to err on the side of the pt., but there's no guarantee it won't get your arse in a bind. She did everything right and he should've waited on administration.

Yep. Officer truly jumped out of the frying pan into the fire.

I'm certain he will be reprimanded and have a permanent mark on his record.
