That changed the moment he followed him and shot him while he was faced down.
If he'd have just shot him right in front of him while he was coming at him with the bat he'd be fine. When the dude started running off I could understand squeezing off a few more just from adrenaline (although I'm not sure a jury would like it).
Walking after the guy and putting several more rounds in him while he's on the ground will likely put this shooter in jail.

Would you keep stabbing a guy over and over who was running away from you and then lying on the ground because he might possibly have a gun?

For all you know he was running to get a gun.
Not guilty.
Not guilty.

You're taught to keep shooting until the threat is completely stopped.
The threat was stopped. The guy was lying motionless face down. This is murder in all 50 states.

I can promise you it won't be hard to find a video of other people being shot, falling to the ground face first, then turning around and still remaining a threat.
The guy could have gotten back in his car and driven away. He would have only been a threat because the shooter walked up to him instead of driving away.

Damn, he emptied the mag. Even without the gun I’d probably take blue shirt in the fight. Red shirt is the epitome of “I’m fat but if I cut my sleeves off I’ll look tough.”

Yeah the standing over the instigator and unloading all those rounds into him is going to be extremely difficult for any attorney to overcome.

Fat guy was clearly the aggressor but standing over him and emptying the mag into him will be a problem for that guy assuming this was in the US.

That's the thing. The shooter does not have to worry about retaliation now.
Or a huge Lawsuit paying the Medical bills if bat guy was crippled for the rest of his life.

I guess the jury vote sends a message.
If you call it murder, you're kind of defending the piece of shite that stopped his vehicle and attacked with a bat. You're emboldening violent criminals to attack first and then expect sanctuary by running away.
If you say he's innocent, you're supporting overkill. This will somewhat discourage self defense shootings.
I'd rather defend the overkill and lay the burden of fear on the attackers of this world, than the victims of road rage. I'd say he was temporarily insane from being in a life threatening situation.

Only two cars on the road and they can’t find away to just get on with their day.

Not really. The initial shoot was justified. No question.
The problem is the walk up and execution while he was lying face down.

Not a problem if I’m on the jury.

That’s what I call F around and find out

First three are good shots. After that, it's a problem. It it were La., shooter would probably be facing manslaughter carrying 3-to-40.
