There is no investigation. You're watching a man who was one of the three that managed to get himself arrested at the Jeff Davis monument as he told a 911 operator to send the US Marshals.

If Mitch thought he fricked up on that Statue, this would be a great out. He gets NOPD to investigate, they sort of think it could be, he comes out and says they will put it back up, it is a grave site.
He plays both sides like fiddles, then continues to frick the rest of NO over with LEE and another statue.

People do realize that he's buried in Metairie Cemetery, right? This statue was built 20 years after he was buried.
