New Orleans man to stand trial for shooting blacks during Katrina in Algiers

While Bourgeois was not a police officer, the racial dynamics of his case made it notorious and drew scrutiny from federal authorities. Bourgeois allegedly warned that he would protect his Algiers Point neighborhood by shooting “anything coming up (the) street darker than a brown paper bag.”
He was accused of firing a shotgun at three black men who were trying to evacuate on foot through Algiers Point on Sept. 1, 2005, three days after Katrina’s landfall. Bourgeois later allegedly bragged that he “got” one, even displaying the bloodied baseball cap that fell from the head of Donnell Herrington, who was shot at Pelican Avenue and Vallette Street.
Bourgeois is also accused of telling a witness to lie to investigators looking into the shooting. A federal grand jury indicted Bourgeois in 2010, and he pleaded not guilty. Then the case was delayed more than a dozen times because of questions about whether Bourgeois had the physical and mental capacity for a trial.

Details about Bourgeois’ health have remained largely under seal, though Lemmon remarked that the defendant was “physically incompetent” to stand trial before postponing the case indefinitely in August 2014.

I’m certainly not defending the guy’s actions, but
doesn’t make sense. It’s a point of land surrounded by water. If you’re evacuating, why would you walk into Algiers Point? The victims had the right to walk wherever they wanted, but it doesn’t make sense if they were evacuating.

Everything made perfect sense post Katrina.
The other option was walking down the expressway where JPSO was threatening to kill everyone.

If he is not "physically competent" to stand trial then he needs to be committed to a mental health facility for a long time. It is clear this dude has a few screws loose.

They were trying to get to the ferry terminal(the blue square) by Morgan St, the red marker was where they were shot.

It’s shocking to me that the ferries were running, but if so that’s a very valid evac route, made deadly by an insane person.

The ferries weren't running but the Coast Guard was conducting Operation Dunkrik from the Algiers terminal.
Everyone evacuated from St. Bernard and parts of NO East were brought there, twice a day they would then bus everyone out of the city from that site.

That's fricked up. He had a right to protect his home from vagabonds but if they posed no threat at all then he should go to prison.
It's amazing how fast common sense and civility degrade into anarchy during these times. Real Lord of the Flies shite

Does anyone have the addresses of the 3 men evacuating, 3 days after Katrina?
Would explain how they ended up on Pelican in the middle of the neighborhood when Patterson/River Rd or Opelousas would of been a direct path depending where they were coming from. There’s only 4 streets that could of led them on Pelican.
It wouldn’t be out of question that they may of been scoping out the area to loot. Evacuating sounds like a good excuse though.

Let's say that they did have evil motives, if this guys wasn't physically threatened than he is still legally wrong.

Yea, I’m not condoning what he did, I’m asking how did they get on Pelican St.
Were they in the middle of the street and he just walked up and shot them?
Did they pop out from an alley and bang?
What time of day was it?
I only read the link provided.
Just asking questions before I take a side.

Yep. You can't go out and shoot unarmed people on the street (and they were presumably unarmed if they didn't shoot back).
If he wanted to defend his property, he could have stayed in his house, where there's no bag limit. Also isn't a good look to announce his intentions in advance and collect trophies afterward.

If he has enough sense to tell a witness to lie, then he knows what he did was wrong. He seems like a scumbag to me - lock him up in prison.

Surprised that douche didn't die of old age waiting on the trial. Damn

No alleys by that corner. This was about half a block from the Algiers Point library.
