Eta: you need to marry that second bitch right now. Also if you are paying full load for the first kid negotiate that you want to claim him on your taxes. EVERY YEAR. I would report any damning behavior about the mother to the judge. Does she do drugs!?

It won't. She can still go after him for retroactive support. But If he kept records, receipts, etc for any past support that he has paid her then the court will recognize those payments and adjust accordingly.

It takes two to tango. And yes, she should have taken him to court from the get go and get a child support Order entered by the court. Both of them were irresponsible in all of this. Because of that, if his case goes to court, it is going to be more expensive than if they would have initially gone when the kid was born

If he signed the birth certificate or anything doing with the assumption of paternity, I think that doesn't matter.
At least I remember in another thread in a few states this being true.
