if it was me though if someone or something made the offender break off the engagement with me, and I was unhurt, I'd probably get to moving the opposite direction once it was clear he was leaving
if for no other reason then I don't want to have to deal with the fallout

If you shoot someone in the back who has a gun, should you be charged? Did you watch the video of the cops driving over that chick yesterday?
Someone can still kill you when they're running away. I know I could.
