CAF is truly mind blowing.

What about the countless people who did not break the law, or just got pulled over for speeding then had the cops steal all their shite based on nothing more than suspicion of other illegal activity? Then had to fight and sometimes lose costly legal battles to get their assets back when again they did nothing wrong in the first place.

Most people, at least in Minnesota, don’t fight it because of the costs. Minnesota creates an entire seperate case for the civil forfeiture that does not follow the criminal allegations, which means an additional set of court fees,administrative fees, travel expenses, attorney fees

As a law enforcement officer, I have huge reservations about CAF. It would be completely fine with me if there were no forfeiture proceedings until post-conviction.

Simply put, because they charge your property with being guilty of a crime. Because your property has far fewer rights than a human, our laws say its allowed, and its assumed to be guilty and has to be proven innocent.

Its a clever bit of legal thinking. As an example, look at the case names of some of the CAF cases- State of Louisiana v. $2,000 for example

It takes a legal system and typically a trial that is presided upon by various experts in their field. It's called due process, and it's the reason that the US isn't some shite undeveloped backwoods nation that you would rather make it.

Civil asset forfeiture is probably the biggest disgrace to our justice system and an affront to the constitution and bill of rights.


There is zero justification for taking the whole sum of what someone has earned (and sometimes that of their family) just because they sling some dope on the side.

Great. You'd like to see a citizen that has begotten their wealth from criminal activities to have the best legal representation?

I'm sure you're tune would change if some drug lord, who got off multiple times, ended up killing someone you loved.

In this country criminal activities are judged to be so after criminal trial, not before.

I'd like to see a link on that. Granted, burglars aren't stealing a fricking house at a time or 100k+ in cash.

Beaides that point and if true, you're really only proving what the LEO is saying as a proponent of the law, CAF can increase police acquisitions and help reduce crime.
