Man shoots intruder then goes back to sleep, charged with murder

Without reading anything but the headline. If someone broke into my house and I shot them but did not alert authorities....yeah I can see you getting in some shite for it.

He also admits to blindly shooting at a target he couldn't see and was retreating. That appears to be the shot that killed the guy. Yeah, dude is fricked.

Murder? No.

Depending on how many bullets he fired off on the 'victim', it could catch up to him with manslaughter, but if I'm his defense attorney, I'm claiming it was 'heat of passion' or even self-defense.

If that's what happened, he won't be convicted of murder.

Weird that the warrant for his arrest for murder describes the "crime" as something perfectly legal in Texas.

Maybe it's the second shot? You can shoot a fleeing thief if he has your property and you reasonably think that's the only way to recover the stolen property. If his hands were empty, that might be the reason for the charge.

Edit: yep, CNN's shitty article didn't go into detail:

If I had him in the interrogation room, I would try to get him to admit that he made up the part about the guy coming at him with a pickax as a way to justify the shooting once he realized he killed the guy.

He says the robber had a pickaxe and he dropped it and running away, so the robber didn't have anything from the guy's own story.

Right, that's why I said if his hands were empty, he's in the wrong. See my edit, that's exactly what the charge is for. It's the second shot after the threat was ended.

I only wonder if they can prove the first shot killed him then he can try to fight it that way. The articles don't say how many GSWs the guy had. CNN says he had one in the back of his neck, but doesn't say if it's the only one.

Similar to the Dallas cop trial, you can be charged with murder and convicted of the lesser charge of manslaughter.
