Forreal though, if a sober guy picks up blackout chicks at the bar by luring them with rides home and has sex with them, wouldn't that be rape?

I honestly didn't care except for the condom thing though.

hell yeah...that is why I made a comment earlier to a guy who said the guy who blacked out deserved it...he never answered. If that is the case I guess any woman who passes out deserves getting assaulted and the man can't be charged

He should have filed a sexual assault complaint against her. Clearly she should have known that he was inebriated, and that any actions taken against him would be therefore without his consent. This seems like an open and shut case.
