one of the worst parts about these scenarios is that pretty much all states have made expert testimony on false memories inadmissible. one day i may actually do a scholarly-legal article on this issue in this context. the law bends over backwards for the victims and tramples on the rights and defenses of the criminally accused (again, pretty much the lone area of exception)
the most brain-draining aspect is that we can't even have a real discussion about this due to people who throw out "drive bye dismissals" like you just did on this page

I'm not talking about being excused for bad choices
Example A:
Male is sober and female is drunk and he has sex. I see how this can be rape
Example B:
Male and Female are both wasted. How can you now choose who is guilty of rape?

In his hypothetical, who made the bad choice?
But yea, that analogy was terrible to his hypothetical, it made no sense. The better analogy on his shooting angle would be 2 people wake up in teh morning next to each other and both have a bullet hole in their body and a gun in their hand, but both don't really know WTF happened the night before. Stupid I know, but that's the best it'll get doing a shooting analogy.

There are many ways to determine if rape is involved in Example B. If there is another hypothetical, apologies.

I thought in order for a man to be raped, it would have to involve penetration of HIS body (either oral or anal) How can an erection get "raped"?

It did not say when she passed back out. Could have been immediately or 5 or 10 minutes. The police have more info maybe. But I agree, the burden of proof is on the defendant in cases like this and it should not be. Burden should be on the prosecution, as in all other cases. However, as we know they get the benefit of the doubt.
