Maybe she was still upright at the time, but the fact remains that her BAC was over 0.3. That's considered close to alcohol poisoning. There's no way to legally consent at those levels.

What I’m trying to say is that none of you know anything, but hearsay. Other than what was on the videos shown. Which was : her chasing the guys down, and her calling them names for not wanting to screw her.

Who actually killed the girl? Did she go with the guys willingly? Yeah her BAC was high but it seems more tragedy followed by a horrible accident then anything else.

In the State of Georgia, if you are too drunk, even consent doesn’t matter and you can be found guilty of rape….and there is only 1 degree of rape in Georgia. It is punishable by a minimum of 25 years in prison to life, and also death penalty eligible.
I was the foreman on a jury years back and learn a LOT about it. And this was some corporate workers at a law firm during someone’s retirement party when it happened in a parking garage behind a Taco Mac in Buckead
Also learned that Sodomy isn’t just butt stuff, but actually ANY oral sex which is also illegal in Georgia
We also found him not guilty of sexual battery because the prosecution never proved he touched her boobs. It was a very crazy, long and emotional trial

This doesn't have anything to do with the rape. It is 2 separate incidents which is why they haven't been charged with murder/manslaughter/negligent homicide, etc.

If we're playing courtroom, no comment.
But on this forum, to treat this as "2 separate incidents" is arbitrary. So let's look at this across its lifecycle:
a) Who (Carver) takes a rabid dog (Washington) to a kid's park?
b) Who remarks "they finna rape her?"
c) Who offloads an obviously disorientated girl at 2AM in 33 degF temps when there were multiple far nobler options easily at hand? Why didn't they do so?
FTR: a British newspaper reported it was raining. I don't think that was accurate. It was near freezing but it wasn't raining.
d) Do sober people just wander onto an open highway in front of an oncoming vehicle?
