Just like the amendment, it’s performative, not substantive. Only difference in penalty for 1st degree and 2nd is the addition of the death penalty.

He’s 17, so no death penalty…and his life sentence has to have a path to parole. He may be convicted of 1st degree, but his maximum penalty will resemble manslaughter.

I see what they are trying to do….and totally agree with it. However, if the 1st degree murder charge is not adequate, why not “fix” that law instead of creating some more confusing laws. Seems like they are just creating another equally vague law that has the potential to be abused.
