A good attorney would say this is an admission that you realize you owe her money.

Floors were about $8,500

What if I take the monthly rent times 4 and deduct from floors and pay her that?

By deducting the 4 months would make "my cost" of the floors $2,500.

If Jethro is understanding and figuring correctly...are you saying you were renting this place for $1,500 a month?

2) she would be staying there indefinitely

I asked if she wanted to buy the house. She told me she was not ready to purchase and would not be ready for a long time.

Let me guess, you wanted to sell the house to her at the price with the new floors?

LINK

Well, this link makes it sound like you legally owe her money (or you can demand she remove the improvement)...

House closed last Wednesday. I guess she could go remove the floors out from under the new owner?

I am in Texas. Anyone have a similar link for this state? I can't find it.

Have not read the link...just taking your word for it.

Remove the improvement.

Then he is left with a house with just sub floors.

Then he can sue her for damaging the property. She can counter sue maybe...

They both end up with thousands in legal fees, time wasted and a house that can't be sold until new floors are installed and their lawyers just added a couple days on to their beach vacations.

Perfect outcome.

If you want a judge to confirm what you already know about yourself in open court, then don't pay anything. Otherwise, pay the $2,500.

But since the house just closed, you now have the money I assume?

Nope, house did't sell for what we needed it to.
New home down payment took almost all of it.

This is called karma. You should be nice to her. She's a bitch.

Wow...just think if the house did not have upgraded flooring?

Are my figures correct in that you were renting the house to her for $1,500 per month?

Legally she is fooked. She cannot possibly take her new wood floors out and restore it to the condition it was in before she changed it.

She is mean for bragging about duping her hubby in the divorce.

She is stupid for putting floors in a rental house. She is stupid for thinking people will act honorably when they cannot be forced to legally.

Did the floors add $8500 to the home's value?

Morally, you should take whatever you actually had to come out of pocket for added expenses that her leaving early caused, subtract it from whatever value the floors added, and pay her.

Sorry, missed that post.

No, let me explain my screw up.
8500 for floors
4800 for rent
3700 goes back to her

Sorry for the wrong figures.

House was 1200 a month.

Screwed up deal. This lady went ahead and dropped $8500 on flooring for a house she knew was for sale and then left the house early?

Okay, I may be the jerk here but you don't owe her squat for her stupidity. Also, if you do decide to give her some money for the flooring she needs to understand that you don't get dollar for dollar for that type of improvement. Personally, I would have never allowed the improvements to begin with.
