If it is worth more $1,000. That may not matter given that he was in possession of a firearm while in the act of stealing it.

let's say for kicks , the driver confessed this.

He confessed to trying to steal something, which is what caused the altercation? And he knew there were no other witnesses?

In that case, the driver is a dumbass.

ETA: And if you go on the lam for a couple of days while knowing you are being sought in connection to the homicide and you don't have sense enough to line up a lawyer during that timeframe......you're even dumber. It sounds like he has already done way too much talking, and even a court appointed attorney would have saved him from himself.

Maybe it was in a parking lot of a store , with cameras that saw the whole thing.

I can tell you he has already talked way too much if he told investigators that he tried to steal a PS5 which ultimately lead to the death of another person.

dont know what authorities or lawyers know. All I know is this was an alleged story passed on from one of the parents of the kid with the weapon to another parent and it got passed on and so forth. Said the kid confessed to his parents what he did.

Whatever answer you give in class, your professor will tell you it's wrong.

Committed felony and then shot and killed someone. That creates 1st degree murder charges Kind of like robbing a store and shooting the clerk

If you are that stupid to willingly get in that "scenario" then Darwin's Law proves correct again.

just a story of a something that happened in a friend's hometown. There was a debate on what the verdict would end up being. That's why I asked the question. Either way, one kid is gone and the other will be in jail most likely for life.

don't know. i was told the story(I have family in Baton Rouge but I live in S.Fla.) and we were just wondering what verdict could come off it. Don't know anyone involved.

What sparked my interest was someone tried to tell me the driver was attacked in his car that he was defending himself but I said what everyone said, he was trying to steal someone else's property and shot and killed someone for getting punched in the face. Shot the guy while committing a crime.

Someone else said, just because he was stealing the dudes xbox or whatever doesn't give him the right to punch him in the face inside his car, that his car was an extension of his house and had a right to protect himself. This is just crazy how people think now a days.

I was like wtf?

The shooter is going to jail for the rest of his useful life, if not the entirety of it.

Happened at Neighborhood Walmart in NI recently. Young guy working at Walmart lost his life over an xbox sale gone bad in parking lot.

Detectives identified 24-year-old Jahari Ajani Allen Jr. as the suspect. Arrest warrants have been issued for Allen, who is wanted for second-degree murder.

Even if it is a hypo you have to add the jurisdiction. Homicide laws vary significantly by jurisdiction and many do not follow the generic Hollywood version of the levels of homicide. Homicide "in commission" statutes often rely on the severity of the underlying crime so you have to adress that as well. In the case of theft if a felony is required to increase the homicide charge particulars about the theft including the FMV of the item* may be important.

* courts are usually very flexible with FMV when it comes to increasing charges
