ETA: And if you go on the lam for a couple of days while knowing you are being sought in connection to the homicide and you don't have sense enough to line up a lawyer during that timeframe......you're even dumber. It sounds like he has already done way too much talking, and even a court appointed attorney would have saved him from himself.

I can tell you he has already talked way too much if he told investigators that he tried to steal a PS5 which ultimately lead to the death of another person.

What sparked my interest was someone tried to tell me the driver was attacked in his car that he was defending himself but I said what everyone said, he was trying to steal someone else's property and shot and killed someone for getting punched in the face. Shot the guy while committing a crime.
Someone else said, just because he was stealing the dudes xbox or whatever doesn't give him the right to punch him in the face inside his car, that his car was an extension of his house and had a right to protect himself. This is just crazy how people think now a days.

Happened at Neighborhood Walmart in NI recently. Young guy working at Walmart lost his life over an xbox sale gone bad in parking lot.
Detectives identified 24-year-old Jahari Ajani Allen Jr. as the suspect. Arrest warrants have been issued for Allen, who is wanted for second-degree murder.

Even if it is a hypo you have to add the jurisdiction. Homicide laws vary significantly by jurisdiction and many do not follow the generic Hollywood version of the levels of homicide. Homicide "in commission" statutes often rely on the severity of the underlying crime so you have to adress that as well. In the case of theft if a felony is required to increase the homicide charge particulars about the theft including the FMV of the item* may be important.
* courts are usually very flexible with FMV when it comes to increasing charges
