LaPlace man charged with murder for shooting man who reached into his truck.

Hmmmmmm.. A lot of people here have been saying they would 100% shoot a man who aggressively approached their vehicle.

He also had a $500,000 bond.

I can't tell you - I honestly don't know all the facts of either case, but I agree they're very similar on the surface.

Pops pled guilty to murder, too. I'd have taken my chances with a jury, even in JP - FFS he was 75 at the shooting and 77 at the guilty plea - NO CRIMINAL RECORD.

He did only get 5 years, but that might as well be life.

There are details that probably won't help his case. If this had been a spur of the moment thing, he'd probably have no problem walking from this.

Yep:

The police noted, however, that Batiste made no attempt to get away from Vicknair's aggressive behavior. Batiste surrendered and was held in the parish jail in lieu of a $500,000 bond.

Scanned the article...

My initial observation is that the shooting took place in early May and the criminal indictment was in Mid-Sept. Was the shooter jailed during the interim period?

This Gasser guy isn't out of the woods yet. He may very well find himself indicted by a Grand Jury or even charged sooner, if more compelling evidence surfaces.

Ronald Gasser could have driven to a police station, Gasser could have driven away. Oh yeah, opinions don't matter. Fact is you can kill anyone who approaches your vehicle in a threatening manner, so says the consensus of the OT.

(my opinion --- Both Batiste and Gasser are wrong)

there are differences for sure. Batiste is negligent.


Just this kind of shows you can't just shoot anyone who reaches into your vehicle.

also the Batiste incident happened where a tow truck was blocking the road, and then moved and he was free to leave. Vicknair ran up to his truck (in the street), and instead of pulling off Batiste stayed and accepted the confrontation. My guess is that Gasser did not have that option

I didn't know at first he left and came back. That shows intent, hence the murder 2.

Damn. move along.
