Kentucky prosecutes it under Wanton Endangerment. In Indiana it's a Class D felony to not let your sexual partner know.

Theres always a bill or referendum.
Theres one now to make a few states.

Yeah, and it's no longer a felony to donate blood when you know you're HIV positive. This is almost literally the Joker's plan in Arkham City by donating mass amounts of infected blood to hospitals and holding Batman and the citizens at ransom over it. But hey, an extreme clear felony offense is now just misdemeanor.
