You have to prove his guilt beyond a reasonable doubt with admissible evidence and he isn't required to testify.
I highly doubt he was attacked in the manner it has been reported, but unless he admits to le or someone else that his report was fabricated, it's a tough task to prosecute him.

All the cops have to do is ask for permission to contact the cell provider to request a crosscheck of the two numbers to get a call time. That way they don't have to grant access to the phone
