Jury trial vs only a judge

Have a friend that got a dwi and wants a jury trial. I told him he was an idiot based on the braindeads out there AND the majority of people look down on DWI’s (rightfully so). What say the OT?

Sounds like the brain deads would help his cause

My lawyer wife always says if you're guilty you want a jury and if you're innocent you want just the judge.

He only needs one out of 12 to be sympathetic.

Jury for a DWI .. Just need one drinker or one person ever harrassed by an over zealous cop.

If you're going to trial for a DUI, you've either (1) already gotten multiple DUIs or (2) have a terrible lawyer.
You're fricked either way

True or the flip side. You only need one that worships MADD

For the jury to hang. Still need all 12 for a not guilty verdict.

Why are you/your friend going to trial for dwi? You kill someone?

Usually the penalties for a 1st offense DUI, while a pain in the arse, and costly, are not terribly onerous. Thus, it's hard to see a really good reason to go to trial unless you weren't drinking, at all, the day/night you were arrested, and you are pretty damn certain you can establish that. If not, you run the risk of losing at trial and getting a much harsher penalty than you may have received with just a guilty plea.

Meh. Sometimes you can have the greatest lawyer in the world, but the client still gets to make the call on whether to go to trial or plead guilty.

I believe he has had two, but apparently there are some issues with this one. I did tell him his attorney blows

Bench trials are good for things that are overly technical or rely on confusing law that jurors won’t understand.

Your friends a POS and has an attorney, I don’t know why you care

Why is he a POS? You’re the reason I advised him to avoid a jury

I would vote innocent based on effort.

Or (3) you're getting railroaded into a DWI by an over zealous cop and you're standing up for justice.
I once paid $2500 in fees to beat an $800 ticket.. Why? Because I wasn't gonna stand for it..
ETA- NOT a DWI
