He is trying to get the jury to vote for him despite his guilt. It is called jury nullification, and this may be the most raw example of the practice in decades. Even if he can get a single holdout juror, he has a hung jury.

Jury nullification is not an act of willful blindness. Rather, it is an act of willful disregard of the evidence. It occurs when jurors acquit regardless of the evidence of guilt. It is not that they don’t see or understand the evidence; they simply choose the individual over the evidence.

Jury nullification has its place in Common Law. It’s a check against when the proper administration of a law (well-meaning or not) would still lead to an unjust outcome.
That being said, Smollett forced to pay in terms of prison time and criminals fines for wasting resources would be a JUST outcome.

Everyone hates Jussie, so he will be convicted, but even if not he’s done. He will be mocked until his dying day as Juicy Smólliett. His life is over regardless.

But black people should hate Jussie because he cried wolf on an idiotic hate crime, but now when one actually occurs in Chicago all the cops will be thinking of is Juicy and take their time getting there.
