It is in the revised statutes. My bad.
However, the emergency powers granted to the Governor are also in the same RS. Therefore, his argument is that the part of the statute that benefits him is constitutional, whereas the part that doesn’t isn’t. I’m not sure how that’s gonna fly. It would make him a virtual dictator.
