However, my point is the officer should have not even pressured my friend into consenting to a search for such a minor violation. Especially since he walked up to the car and saw five kids all wearing purple and gold on the road to Auburn. It was clear we weren't running drugs, he just decided to give us a hard time and maybe get an easy bust for marijuana possession. This is just one minor step in a dangerous trend that is obvious to anyone with an objective mind.

Oh--the police will say it is, and the courts will agree, but it's not a Terry Stop.
What a disgusting rule of law that was, by the way; it's opened the door for much of this.

Why do we keep singing the songs about "the land of the free" and all that?
Seems to me, with warrantless searches, the Patriot Act, this, etc. the words needs to be changed to "the land of the semi-free."

To an extent, yes. But if enforced correctly, Terry gives people a right to exercise their 4th amendment rights more clearly.
This is an utter disrespect of Terry v. Ohio, which is ironic considering this took place around 60 miles from where Terry occurred in 1963.

The stop and frisk aspect of Terry is really bad because it's used as a tactic by police to find probably cause.
NYC uses Terry to randomly stop and frisk and it's a publicized strategy that the NYC PD admits to.
It's unbelievable.

I've railed on the NYC stop and frisk program repeatedly on here. People give not one frick; they like their rights, not the rights of others. In fact, many think it's amusing to watch others lose their rights.
This kind of shite borders on insane at this point, and it is largely because of laws like Terry mixed with an uneducated police force taught to stop and arrest, letting the courts sort it all out; which, to circle back to your earlier point, is the perfect setup for a class of poors who will be defended by fifty dollar an hour legal failures.

This is how they sleep at night. And it's part of the reason we have the inequality issue in our jails and prisons. Higher numbers of minorities are targeted and don't have the resources to fight the illegal charges. And the fact that it's a he said, she said situation.
All interactions with law enforcement need to be videoed. I honestly applaud this guy. It took some balls to excercise his rights with his 2 week old child with him in the face of unbelievably illegal police activity. I'm trying to find this guy's contact information, I want to send him an encoraging letter and try to find out where people can donate a little for lawyers fees. I think the ACLU will represent this guy though.

I love how the cop keeps talking about driving without lights while the sun beams behind him in the video. Many headlight laws are tethered to official sunrise and sundown hours, perhaps Ohio is not.
