Is this situation fraudulent? What would OT do?

Long story short, my POS brother in law who’s credit sucks took out a credit card in my sisters name.
He used all her pertinent info to apply for and get approved for the card.
He did this while they were separated and he’s apparently managed to charge a good bit of money in just 3 months.

I used to really like the guy but the last year or so he’s gone off the rails.
She hasn’t hired an attorney yet. Seems like that’s what needs to happen. He’s not gonna snap out of this midlife crisis.

Anyway what should she do about the money?
It’s over 6k. Is what he did against the law?

Yes it is against the law. Call an attorney that isn't on a billboard.

Sorry your methy ex stole your credit... they gonna get their pound of flesh so you might as well pay it. Was this cc taken out after the official separation date? Can you prove separation prior to the cc being activated? If so, the court could put responsibility on your druggie ex.

heh, that's what my ex thought too. Didn't work out well for her. She's still on pre trial diversion, on probation and paying me back $20 a month till her debt is repaid to me. Looks like she'll be on probation for the rest of her life. That's ok tho, the money really don't mean as much to me as knowing she has to go each month, get a money order, bring it to the probation office and fill it out.

if he did it while they were separated, and they are remaining separated, really push her to get an attorney.

if they are getting back together.....it is none of your business. walk away.

Buddy’s wife just did the same. They settled a year later. I think he ended up paying the balances if she agreed to not touch his retirements. Choose your battles. Is a couple grand worth putting your children’s father in jail?

This just seems petty to me to think this is funny. If she owes you money, it means she's still in your life somehow and I wouldn't want that at all.

Also don't pay the debt. Report it as fraud to the credit card company and have it removed from her credit report.

Leverage is a MFer.

Let her write her own settlement of what she wants from the divorce.
Then have her write a police statement.
Place the 2 documents side-by-side on the table.
Tell him to pick one.

Yes, it is against the law to open up a credit card in someone else's name. I am not a lawyer but that could be ID fraud.

My wife manages to charge about that much as well and we’re not even separated that I know of.
