Just go in politely and tell them that you are tired of wasting time and would like to get the fair value of the car. If they decline, tell them that all further communications are to be handled through your attorney and that you will get his info to them shortly. They have no bargaining power here at all, you just have to be willing to call their bluff. In the meantime, it wouldn't hurt for your wife to check in with a chiropractor about her headaches.

I have an immediate family member sitting next to me that's an insurance agent and says don't accept any money until you agree on a fair price. It's probably not State Farm or Allstate that you are dealing with here. You can reject their offer. Worst case, call your insurance company and let them fight the other company on your behalf. They may charge you the deductible but they'll get it back for you.

She went to the chiro today and got x-rays and adjusted. He told her that her back is definitely out of line, and he is confident that it is not from standing up all day at work. Said it was from the impact of the wreck. He wants to see her later on this week to go over the x-rays and do another adjustment.

Does your car have a clear title, or is it a reconstructed title, or any other kind of a flagged title? If it's a clear title, you should've been offered NADA retail (or retail for whatever they use to get the value).

ETA There is something flagged on your title or that car had a TON of mileage.

Attorneys HATE 3rd party PD claims, just no upside for them unless it is connected to a decent PI claim and even then they are a pain and clients are rarely happy. I only litigated one PD claim but it was a low mileage semi-exotic "Unicorn" that was worth a significant amount of money hit by a trucking company but even it was a subrogation based suit as Haggerty had already paid the owner.

Insurance companies back more people into fraudulent PI claims than I think they realize, if they would just pay far retail value it would happen far less than it does.

Call your agent and make a claim on your collision coverage. They will probably be more reasonable and will pay you promptly. The amount paid will be less your deductible.

Your insurer will then negotiate with the at fault insurer to get reimbursed. When that is completed, they’ll probably send you a check for the deductible amount.

That’s been my experience a couple of times.

You should be getting Nada Clean Retail plus tt&l for your vehicle. Some companies use CCC, which uses comps in their figure, but nada clean retail is the number that should be used.

La RS 32:702

Louisiana case that lays it out a little

However, don't expect your trial court to be this friendly. An attorney wouldn't expect fees and a penalty to result from your case.

So.......you gotta handle the property shite yourself or negotiate it into the employment of your personal injury attorney. Be careful that your K doesn't allow him/her/it to take a third of the value of your hoopty. You can probably find an attorney that will handle your pd claim for your pi claim. Don't run your meds up too much though.

IDEAS, if you can't wait for your future pi attorney to negotiate the pd portion of your claim:

+ give your adjuster the revised statute...hell, fax a copy of the revised statute and that case...it might not help, but it won't hurt either

+ make sure you are marking everything correctly when you get your up to date NADA clean retail value; right model, mileage, etc; fax this bitch too

+ tell her (your adjuster) that walking to the chiropractor isn't helping your wife's back, so getting a new car would be nice (I hope that you have a rental)

Keep us updated. It's not fun to deal with one of the booboo insurance companies.

Car has 180,000 miles. Which is pretty average for a 14 year old car. Clean title.
