My wife's car was rear-ended while sitting in traffic on Airline, and her car was totaled. The at fault party's insurance is only offering us around the NADA trade-in value on the car and is saying we will not get the retail value. It's a 2004 Kia Optima, so the car isn't worth a ton, but NADA has the retail at $3400, and the insurance is valuing the car at $1847 and saying that it is more than the trade-in value ($1800) so it is more than fair. I've never had to deal with a totaled car before; is the trade-in value normally as high as they will pay out? I know for sure that I could have sold it myself and gotten the retail for it. My last car that I sold was an '06 Altima with 240,000 miles and a transmission that acted up when it was cold. I had someone knock on my door buy it the day after I took the plates off. I hadn't even put a for sale sign on it yet. Any info is appreciated.

Get comps. You should be able to get $3K or more.

We got clean retail with Allstate. You can dispute it with the insurance company.

I don't know what value they normally go by, but I do know they will try to frick you over. And there probably isn't much you can do about it.

It would be clean retail, or since you were hit from behind, develop a headache

They’re supposed to pay good/excellent condition retail value. Tell them you want to handle this as easily as possible, but that if they aren’t willing to give you NADA retail value that you’re getting an attorney involved

Clean retail is what I should be trying to get? I tried to tell her that and she said retail is only what the dealer could sell it for not what I could get because the dealer is a business and I'm not. I told her since they are a business they need to buy trade-ins for less than they are worth to make a profit. She just kept saying I wouldn't get that and all I would get is trade-in.

I'm thinking clean retail is the replacement value, not trade in. Your insurance should be negotiating for you, no?

She’s full of shite. Ask her if she knows a dealership who will sell you a used Kia at the trade in value. You have to pay retail to get another car

ETA: don’t accept anything less than clean retail. Get a lawyer involved if they keep making it difficult. Having to pay attorney fees gonna cost them a lot more than that $1600 difference between trade-in and retail value

Maybe I'm an idiot, but what the hell is your insurance doing?

My insurance was the one who valued my vehicle and paid me. The at fault party's insurance had nothing to do with it.

That's why subrogation exists.

Liability only policy?

Your wife should have a neck brace and be talking to the guy on the right of the OT screen.

Sorry about her accident. I'd assume you are asking us for good spinal doctors for her to go see for that whiplash and maybe therapist for that traumatic experience
