Im not an education law expert. I think the law says that the public school system has to accommodate the child, but not necessarily accommodate the child at the school of the parent's choice.

It would be tough to argue why it is necessary to send the kid to Willow when there are at least a half dozen other public elementary schools within 4 miles of Willow.

Willow's problem is that they regularly accept kids IEP's to get around admissions criteria.

they're looking for gov't paid daycare, that is all. There's nothing that any of those schools can do with that kid. They don't have the SPED teacher for that. But they took one fed dollar...and now they're on the hook I guess. Those parents knew going into the application process where this was going and its all about the fight to them.

However, don't take any fed money and the privates aren't required to hire the teachers for the SPED students. Problem solved.

I would guess that 50% or more of Willow's students have IEPs. Gifted Students are also special education students with IEPs.

Indeviduilized Education Program. It usually means specialized programs for "special kids," but can be finessed to include exceptional kids.

IEP is where, when I was would a kid they called it social promotion came into play. In the 90's Socially promoted didn't get a regular diploma.

Also when Orleans went the charter route. The burbs for the most part kept their schools except a few small ones in Jefferson. I thought Orleans held on to their pride and joy of Ben Franklin, but maybe that has even gone Charter?

Reasonable accommodation is all that is required.

AND

The education of the other students is a factor.

My heart goes out to those parents, but their child would be nothing but a distraction and would severely impede the educational progress of his classmates.

My mom was the director for SpEd in her district, which meant she got to handle all the lawsuits. This is a straight up money grab.

Selective charter. If that means by selective admissions do the parents have a choice? It’s a sad situation, but parents need to be realistic. A regular public school couldn’t turn him away.

At that point, the kid doesn’t belong in a standard classroom. They really need to bring back SPED classrooms. I’ve heard public teachers say they spend so much time on disabled, behavior and non-English speaking kids, there’s no teaching. Regular students are left behind. And we wonder why public education is so poor. Years ago, it wasn’t like this and schools were ok.

I’m sure those kids have cognitive abilities higher than that of a 1-2 year old, like this kid.
